Only 27 percent of Americans in a 1995 Harris poll said they had read or heard “quite a lot” about genetic tests. Nonetheless, 68 percent said they would be either “very likely” or “somewhat likely” to undergo genetic testing even for diseases “for which there is presently no cure or treatment.” Perhaps most astonishing, 56 percent found it either “very” or “somewhat acceptable” to develop a government computerized DNA bank with samples taken from all newborns, and their names attached to (...) the samples. This does not necessarily mean the public is unconcerned about genetic privacy. More likely it means that the public is still uninformed about the risks associated with genetic testing, and has not thought at all about the risks involved in storing identifiable DNA samples.A central question presented by genetic screening and testing is whether the genetic information so obtained is different in kind from other medical information, and, if so, whether this means that it should receive special legal protection. Our contribution is part of the REMILAS project, a research on interactions between asylum seekers and health professionals, with or without interpreters. Here we observe the emergence, expected or not by professionals, of snippets of migration narratives. Our study combines multimodal analysis of interactions (Sidnell & Stivers, 2012) with a critical sociolinguistic perspective (Boutet & Heller, 2007) so as to inform the development of training methods. Our empirical focus will be on interactional moments where the doctor, searching for the information (...) needed to write an expert medical certificate, repeatedly urges the applicant to make certain responses required in it. The essays in this book respond to Anna-Teresa Tymieniecka’s recent call to explore the relationship between the evolution of the universe and the process of self-individuation in the ontopoietic unfolding of life. The essays approach the sensory manifold in a number of ways. They show that theories of modern science become a strategy for the phenomenological study of works of art, and vice versa. Works of phenomenology and of the arts examine how individual spontaneity connects with the design of (...) the logos – of the whole and of the particulars – while the design rest not on some human concept, but on life itself. Life’s pliable matrices allow us to consider the expansiveness of contemporary science, and to help create a contemporary phenomenological sense of cosmos. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

The speed and scale of the COVID‐19 pandemic has highlighted the limits of current health systems and the potential promise of non‐establishment research such as “DIY” research. We consider one example of how DIY research is responding to the pandemic, discuss the challenges faced by DIY research more generally, and suggest that a “trust architecture” should be developed now to contribute to successful future DIY efforts.

The aim of the article is to analyse selected threads of Olga Tokarczuk’s literary work and selected artworks of Patricia Piccinini as a posthumanist critique of anthropocentrism. My analysis will be guided by the question of how art clarifies and helps us to understand a world in which boundaries between species are crossed and dualistic divisions – nature/culture, human/animal, human/machine – no longer apply. I will show that art is a space of expression in which the subjectivity of posthumanist (...) hybrids is given the chance to infiltrate universal consciousness and break down the anthropocentric monolith of western European culture. The article will also cite the posthumanist postulate of decentralization of the human subject, as implemented artistically by Tokarczuk and Piccinini in their works. This postulate signifies the need to accept the new responsibility a human being bears as part of a larger, heterogeneous whole (Donna Haraway), as well as to develop a posthumanist ethics (Rosi Braidotti). With reference to one of Tokarczuk’s essays, I propose to describe this new ethics as ‘sensitive ethics’. (shrink)

Canonically, ethics is a branch of philosophy that studies and systematizes these concepts and aims to rationally define what constitutes a good or virtuous act, regardless of the culture in which it is framed. Morality is defined as the set of norms that govern the behavior of people who are part of a given society, thus contributing to the (...) maintenance of stability and social structure. Based on these definitions, naturalization consists of seeking foundations in the empirical sciences to justify moral principles. The objective of this work is to see to what extent science can contribute knowledge that supports ethics and moral principles, a project based on the naturalization of philosophy, questioning any apriorism that ignores science. First, the naturalizing program and its main variants in philosophy will be examined. Second, two proposals from the philosophy of science that can be framed in naturalism will be analyzed, namely: Philip Kitcher and Patricia S. Churchland. Next, some of the main theses that provide scientific explanation of human behavior from the point of view of moral virtues will be addressed. (shrink)

Cette étude est née de la remarque troublante d’un roman dans lequel un personnage relit Anna Karénine et se rend compte qu’il a tout oublié de sa première lecture : l’histoire, les émotions vécues alors, tout cela paraît n’avoir pas laissé de traces. Je me suis donc interrogée sur la nature de l’expérience esthétique et le type de souvenir qu’elle engendre. Une expé­rience peut-elle ne pas laisser de traces ? mais alors est-elle encore une expérience ? ou bien peut-on (...) envisager des traces qui ne soient pas des souvenirs disponibles, mobilisables à volonté ? et comment alors les conce­voir ? Il s’agissait donc de cerner à la fois le type d’expérience que forme l’expérience esthétique et le type de souvenirs qui s’y constituent. Partant de Husserl, l’analyse a permis de définir l’expérience esthétique comme expé­rience menée dans la neutralité, sur le mode du quasi ; ce faisant cela paraît accréditer la possibilité qu’il n’y ait pas de réels souvenirs mais seulement des quasi-souvenirs. Néanmoins parce que cette thèse reste paradoxale, j’ai cherché le moyen de concilier à la fois la neutralité existentielle de cette expérience dans l’appréhension de l’objet esthétique et la possibilité d’une affection réelle voire d’une transformation en profondeur du sujet. J’ai alors poursuivi l’examen en m’appuyant sur un texte de Roman Ingarden ( Vom Erkennen des literarischen Kunstwerks , § 24) et sur les leçons des synthèses passives de Husserl. L’enjeu de cette recherche engage donc la place et le rôle de l’expérience esthétique dans la constitution de la personnalité. (shrink)

We propose that people typically reason about realistic situations using neither content-free syntactic inference rules nor representations of specific experiences. Rather, people reason using knowledge structures that we term pragmatic reasoning schemas, which are generalized sets of rules defined in relation to classes of goals. Three experiments examined the impact of a “permission schema” on deductive reasoning. Experiment 1 demonstrated that by evoking the permission schema it is possible to facilitate performance in Wason's selection paradigm for subjects who have had (...) no experience with the specific content of the problems. Experiment 2 showed that a selection problem worded in terms of an abstract permission elicited better performance than one worded in terms of a concrete but arbitrary situation, providing evidence for an abstract permission schema that is free of domain-specific content. Experiment 3 provided evidence that evocation of a permission schema affects not only tasks requiring procedural knowledge, but also a linguistic rephrasing task requiring declarative knowledge. In particular, statements in the form if p then q were rephrased into the form p only if q with greater frequency for permission than for arbitrary statements, and rephrasings of permission statements produced a pattern of introduction of modals totally unlike that observed for arbitrary conditional statements. Other pragmatic schemas, such as “causal” and “evidence” schemas can account for both linguistic and reasoning phenomena that alternative hypotheses fail to explain. (shrink)

The ways in which knowledge relates to power have been much discussed in radical education theory. New emphasis on the role of gender and the growing debate about subjectivity have deepened the discussion, while making it more complex. In Getting Smart , Patti Lather makes use of her unique integration of feminism and postmodernism into critical education theory to address some of the most vital questions facing education researchers and teachers.

This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

Husserl’s writings on sociality have received increasing attention in recent years. Despite this growing interest, Husserl’s reflections on the specific role of communication remain underexplored. In this paper, we aim to fill this gap by reconstructing the various ways in which Husserl draws systematic connections between communication and communalization. As will become clear, Husserl’s analysis converges with much more recent ideas defended by Margaret Gilbert and Naomi Eilan.

Intersectionality has attracted substantial scholarly attention in the 1990s. Rather than examining gender, race, class, and nation as distinctive social hierarchies, intersectionality examines how they mutually construct one another. I explore how the traditional family ideal functions as a privileged exemplar of intersectionality in the United States. Each of its six dimensions demonstrates specific connections between family as a gendered system of social organization, racial ideas and practices, and constructions of U.S. national identity.

In Nicomachean Ethics 7.7 (= Eudemian Ethics 6.7), Aristotle distinguishes softness (malakia) from lack of self-control (akrasia) and endurance (karteria) from self-control (enkrateia). This paper argues that unqualified softness consists of a disposition to give up acting to avoid the painful toil (ponos) required to execute practical resolutions, and (coincidentally) to enjoy the pleasures of rest and relaxation. The enduring person, in contrast, persists in her commitments despite the painful effort required to enact them. Psychopaths are agents who lack the normal capacity to feel moral emotions (e.g. guilt based on empathy with the victims of their actions). Evidence for attributing psychopathy at least in some cases to genetic or early childhood causes suggests that psychopaths lack free will. However, the paper defends a sense in which psychopaths still may be construed as responsible for their actions, even if their degree of responsibility is less than that of normal agents. Responsibility is understood in Strawsonian terms, (...) as a question of our appropriate reactive attitudes toward an agent for what she does, and as distinct from the question of the agent's own motivating attitudes, which lead him to do what he does. The latter is the question more directly relevant to free will, though moral motivation normally depends on the capacity in early childhood to pick up motivating attitudes from others' reactive attitudes. Reactive attitudes based on hatred rather than anger (e.g. disgust or contempt) count as alternative forms of blame that may be appropriately directed toward agents manifesting bad qualities of will, even as a matter of motivational impairment. So psychopaths may still be said to deserve blame, even if they are incapable of modifying their behavior in response to blame. (shrink)

Philosophy, in its traditional guise, addresses questions where experimental science has not yet nailed down plausible explanatory theories. Thus, the ancient Greeks pondered the nature of life, the sun, and tides, but also how we learn and make decisions. The history of science can be seen as a gradual process whereby speculative philosophy cedes intellectual space to increasingly wellgrounded experimental disciplines—first astronomy, but followed by physics, chemistry, geology, biology, archaeology, and more recently, ethology, psychology, and neuroscience. Science now encompasses plausible (...) theories in many domains, including large-scale theories about the cosmos, life, matter, and energy. The mind’s turn has now come. The classical ‘‘mind’’ questions center on free will, the self, consciousness, how thoughts can have meaning and ‘‘aboutness,’’ and how we learn and use knowledge. All these matters interlace with questions about morality: where values come from, the roles of reason and emotion in choice, and the wherefore of responsibility and punishment. The vintage mind/body problem is a legacy of Descartes: if the mind is a completely nonphysical substance, as he thought, how can it interact causally with the physical brain? Since the weight of evidence indicates that mental processes actually are processes of the brain, Descartes’ problem has disappeared. The classical mind/ body problem has been replaced with a range of questions: what brain mechanisms explain learning, decision making, self-deception, and so on. The replacement for ‘‘the mind-body problem’’ is not a single problem; it is the vast research program of cognitive neuroscience. This paper argues that Book 3 of Porphyry’s De abstinentia contains an overlooked argument in favor of vegetarianism for the sake of non-human animals themselves. The argument runs as follows: animals are essentially sentient creatures. Sentience (αἴσθησις) allows them to discern what is good for their survival and what is destructive to them, so that they can pursue the former and avoid the latter. As a result, animals (human and non-human) have preferences, desires, and hopes. Having purposeful strivings that can (...) be promoted or frustrated makes them recipients of justice and injustice. This means, for Porphyry, that animals, unlike plants, can be wronged since they are creatures that discern, and purposefully pursue, what is good or bad for them. This reading stands against interpretations that argue that Porphyry advocates vegetarianism only for our benefit, and not for the animals’ own sake. (shrink)

Hegel’s interpretation of Sophocles’ play Antigone is central to an understanding of woman’s role in the Hegelian system. Hegel is fascinated by this play and uses it in both the Phenomenology and the Philosophy of Right to demonstrate that familial ethical life is woman’s unique responsibility. Antigone is revealed as the paradigmatic figure of womanhood and family life in both the pagan and modern worlds although there are fundamental differences between these two worlds for Hegel. In order to situate the (...) interpretation of this play within its wider context I shall begin with a brief outline of the pagan world described in the Phenomenology. I will then consider the interpretation of this play within the analysis of the modern world in the Philosophy of Right. Throughout, the focus will be on woman’s role in Hegel’s philosophy. (shrink)

This article analyzes feminist organizations as a species of social movement organization. It identifies 10 dimensions for comparing feminist and nonfeminist organizations or for deriving types of feminist organizations and analyzing them. The dimensions are feminist ideology, feminist values, feminist goals, feminist outcomes, founding circumstances, structure, practice, members and membership, scope and scale, and external relations. I argue that many scholars judge feminist organizations against an ideal type that is largely unattainable and that excessive attention has been paid to the (...) issue of bureaucracy versus collectivism to the neglect of other organizational qualities. The varieties of ideology, form, and strategy that feminist organizations embody should be analyzed in relation to outcomes for women, the women's movement, and society. As has recently begun to occur, feminist scholars are encouraged to claim the topic of feminist organizations for themselves. (shrink)

ABSTRACT: Hobbes belonged to philosophical and scientific circles grappling with the big question at the dawn of modern physics: materialism and its consequences for morality. ‘Matter in motion’ may be a core principle of this materialism but it is certainly inadequate to capture the whole project. In wave after wave of this debate the Epicurean view of a fully determined universe governed by natural laws, that nevertheless allows to humans a sphere of libertas, but does not require a creator god (...) or teleology to explain it, comes up against monotheism and its insistence on the incoherence of an ordered world in the absence of a God and his purposes. The following questions were central to this debate: Can we understand the universe as law-governed in the absence of a god? If so, what room is there in a fully determined mechanical universe for human freedom? If humans do enjoy freedom, does the same hold for other animals? Is this freedom compatible with standard views of morality? (shrink)

While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. The author extends theory on the relationship between workplace spirituality and business ethics by integrating the "yamas" from yoga, a venerable Eastern spiritual tradition, with existing literature. The yamas are five practices for harmonizing and deepening social connections that can be applied in the workplace. A theoretical framework is developed and two sets of propositions are forwarded. One set emanates from the yamas and another one conjectures relationships between spirituality and business ethics surfaced by the application of these spiritual practices (...) from yoga. (shrink)

Gottlob Frege famously rejects the methodology for consistency and independence proofs offered by David Hilbert in the latter's Foundations of Geometry. The present essay defends against recent criticism the view that this rejection turns on Frege's understanding of logical entailment, on which the entailment relation is sensitive to the contents of non-logical terminology. The goals are (a) to clarify further Frege's understanding of logic and of the role of conceptual analysis in logical investigation, and (b) to point out the extent (...) to which his understanding of logic differs importantly from that of the model-theoretic tradition that grows out of Hilbert's work.
